All rights in these are reserved. Product descriptions, specifications, prices and all other information contained in this web site are all subject to change without notice. Returns, Replacements and RefundsAll good sold by Spy Equipment UK are subject to a 3 month repair or replacement warranty starting from the date of initial receipt. This means that any item that shows fault within the first 3 months of sale can be returned for repair or replacement as long as the fault has not been caused by the user. All repairs are free of charge in the warranty period as long as the fault is not user related. After the 3 month warranty all repairs will incur a fee proportional to the work involved. Spy Equipment UK reserves the right to not replace an item after the 3 month warranty. If an item has been repaired under warranty and returned to the customer the warranty date will not change to the date of repair. Spy Equipment UK do not offer extended warranties. Spy Equipment UK guarantee, at its discretion, to refund, replace, or repair, free of charge, within invoice date any goods proven to be faulty by design or workmanship, provided that the goods have not been misused, modified, or attempted to be repaired by anyone other than the manufacturer and provided that the goods have been stored, operated and maintained within the manufacturers specified conditions. Any damaged goods received by the buyer must be reported to a member of staff within 2 days of receipt (as per the Distance Selling Regulations). ALL Returns must be authorised by a Spy Equipment UK member of staff. Under no circumstances will returns be accepted unless so authorised and no refund or replacement supplied. All items must be sent via a recorded delivery method to ensure all parcels reach us, lack of postage proof can affect your replacement or refund claim adversely. Once the damaged goods are received by a member of staff they will be evaluated and if fault is found then a refund or replacement will be issued. If no fault is found by our technical support then the goods will be held at the Spy Equipment UK office and you will be contacted regarding a shipping payment to get the goods back to you. Once this payment has been received by Spy Equipment UK the goods will be shipped back to you. Under the Distance Selling Regulations you have the right to cancel your order within 7 working days (Before receipt of the goods). All cancellation notifications must be received by a Spy Equipment UK member of staff in writing. If you are not satisfied with your product once received, it may be returned to us with original unopened packaging and in original unused condition within 7 days of delivery date for a full product refund or replacement. Any item returned in a used state or opened packaging will not be eligible for refund or replacement. All returns, as stated above, must be authorised by a Spy Equipment UK member of staff in writing. All returns for refund must be accompanied with a copy of original invoice or order confirmation. The refund relates to price of goods only and excludes carriage; the customer is responsible for all carriage charges. For goods that are returned within the 7 day period but are not faulty we reserve the right to deduct an administration charge of £7.50 per product from any refund. In the event that you return a non faulty GPS Tracking Device and Managed SIM in this 7 day period we reserve the right to deduct a £35 repackaging and testing fee from your refund. Bespoke or non-standard items manufactured/made to/or adapted to a customers' requirements, by their very nature, will not be subject to a calling off or cancellation period or refund specified in Distance Selling Regulations. Distance Selling Regulations only apply to purchasers from the UK. Software sales, due to the nature of software supplied by Spy Equipment UK, class as non-standard items and are not covered by the distance selling regulations or our returns policy. Refunds will be processed within 30 working days from the date we receive the product in its original condition. DeliveryAll delivery times stated by any Spy Equipment UK member of staff either on phone, via e-mail or in face to face consultations may be subject to change due to unforeseen circumstances. All goods will be sent via a 'Signed For' system, if for some reason you are unavailable to sign for the package it will be taken to your local Postal Sorting Office. It is the responsibility of the consumer to contact the sorting office and arrange re-delivery. In the event that no collected is made by the consumer the package will be returned to us. As such we reserve the right to charge additional postage costs for any item that must be re-sent by ourselves. User ErrorSpy Equipment UK is not responsible for incompatibility errors with software or operating systems for any of our products after the point of sale. Spy Equipment UK will attempt to inform all customers of system requirements in the Product Description however it is the customer's responsibility to ensure the product will work with their system. If you are unsure please contact us to discuss any additional system requirements. All items are fully tested by a Spy Equipment UK member of staff to ensure they work fully. Spy Equipment UK take no responsibility for user error that may cause damaging side affects to either the product or anything working in conjunction with said product. If this occurs the user will not be entitled to any form of refund or free replacement. Fraud Counter-MeasuresDue to the high level of on-line fraud in today's world, Spy Equipment UK undertake extensive security checks on all transactions processed through our website in an effort to secure not only ourselves but our customers as well. As such Spy Equipment UK reserve the right to request additional information to back up or support information already provided by a customer in regards to payment security checks undertaken. This can take the form of a scan or fax copy of the front of the payment card used, photographic ID, a bill relating to you at a seperate address, etc. Please ensure that all information provided is correct and up to date. Refusal to supply this additional information will result in the cancellation of your order. All first time orders, or orders of £250 or greater must be delivered to the billing address of the payment card. Spy Equipment UK will not ship goods, on orders stated previous, to a separate delivery address due to massively increased on-line fraud, unless stated otherwise by a Spy Equipment UK member of staff. All international orders over £350 must be paid for via Bacs or Cheque payment only, unless stated otherwise by a Spy Equipment UK member of staff. Conditions for Free ShippingSpy Equipment UK offer free shipping to any address within the UK on any order valuing over £100 before VAT. The Free Shipping offer is equal to the Standard Shipping on orders below £100 and so is sent via Royal Mail with a 2-3 working day delivery time. Any item returned under our returns policy that had free shipping will have the standard shipping fee of £6 deducted from any refund on top of any other deductions. PayPal PaymentsSpy Equipment UK also offer the choice to send payment through the PayPal system for quick and safe payment of your order. Please note that all items, paid for by PayPal, that have free shipping selected will still be posted via a Royal Mail trackable postal service to ensure that we can prove receipt of your order. All PayPal charge backs will be disputed to the fullest possible extent and as such we ask that any customer who is unhappy with their purchase to contact Spy Equipment UK before taking such action. Any purchase of Covert SpyPhone Software paid for via PayPal payment will have the software file and software manual e-mailed through to the PayPal registered e-mail account and NOT the e-mail account registered on the Spy Equipment UK website. Fair Usage Policy for Managed SIM CardsAn excessive usage policy applies to this contract: Unlimited tracking SIM provides unlimited tracking to be used from your tracking device sold with the SIM for private, personal, commercial purposes. You may not use your SIM Card - in, or connected to, any other device; or in a way that adversely impacts the service to other Tracking customers. If for any reason the SIM Management Company reasonably suspects that you are not acting in accordance with this policy, the SIM Management Company reserves the right to impose further charges, or transfer you to a tariff which does not include unlimited tracking, or disconnect your account. Title in any SIM Card will never pass to a Customer but will remain vested in the Network Provider. All risks in a SIM Card shall pass to the Customer upon delivery by the Company or its carrier of the Equipment to the Customer’s nominated address specified in the Particulars. Once delivery has taken place the Customer is responsible for any loss or damage or unauthorised use of the SIM Card together with the cost of any replacement required. All rights in any numbers allocated to Customers shall at all time remain vested with the Network Provider. If any number allocated to a Customer remains disconnected from the Services for any reason for a continuous period of 6 months the Network Provider may withdraw and re-allocate to a third party any such number. PAYG SIMs in GPS TrackersAny GPS tracking device sold by Spy Equipment UK with a Pay As You Go (PAYG) SIM card will be supplied with a Vodafone PAYG SIM. For a Vodaphone PAYG SIM to work with your tracker there must be a minimum of £1 credit on the SIM. It is the responsibility of the customer to ensure that the PAYG SIM is kept topped up with credit. With a PAYG SIM in your tracking unit Spy Equipment UK cannot guarantee regular, accurate repots when the unit is in an area of busy or poor signal due to PAYG SIMs being the first to be reduced to lowest priority by any SIM Company. In addition, any Vodafone PAYG SIM that is not active for longer than 1 month has a high chance of being deactivated and the phone number 'recycled' to a new SIM. In this event your tracking unit will no longer be able to send out any position data. To combat this Spy Equipment UK suggest, when keeping the tracker in storage, that you activate the unit a minimum of once per month and conduct a small track to ensure the SIM is still active. Keeping the PAYG SIM active and the unit tracking is the responsibility of the customer and as such Spy Equipment UK do not take responsibility for and PAYG SIM that is deactivated due to lack of activity. In the event that your PAYG SIM does get deactivated you will need to contact Spy Equipment UK and send your unit back to us, we will then open the unit and replace the SIM card for a working PAYG SIM. If anyone other than a Spy Equipment UK member of staff attempts to open up a GPS Evolution tracking unit your warranty and any future assistance will be void. In the event that we have to change a PAYG SIM in a GPS Evolution a fee of £45 + VAT will be charged before work will begin. SIM Recovery Pro/PhoneFile Pro DisclaimerDue to the extensive range of mobile phone handsets and the way these handsets manage SMS messages, we cannot guarantee that our product will recover data from every SIM card. However we have recovered a substantial amount of deleted text messages from all the SIM cards tested and therefore approved the product for sale. All mobile phone handsets work in different ways and new models are being released all the time, as such it is not possible for Spy Equipment UK to compile a compatibility chart. Some handsets also do not save any data to the SIM card; if this is the case no SMS messages will be recovered. We ask that you contact your handset manufacturer to ensure your handset has the ability to save data directly onto the SIM card. If a SIM has been locked with a SIM PIN you will need to know the PIN Code in order for the unit to work. In addition some newer phones perform a permanent delete on the SMS messages and these will NOT be recoverable. There is no way of knowing this in advance and is something you will have to try on a 'trial and error' basis. We would recommend contacting your handset manufacturer to confirm if your model handset has this permanent delete function. Due to all the above reasons, the lack of information being recovered will not be accepted as a valid reason for return. GPS Vehicle Tracker HireSpy Equipment UK offer the ability to loan one of our GPS Vehicle Tracking Units from us for a selected period of time. The loan works similar to a purchase, with the user paying the full purchase fee up front as a deposit, then having the payment refunded minus the loan charge once the loan period is over. Only under certain, special circumstances, and specifically at the Owner's discretion, will any flexibility be offered on these Terms of Hire. Legality of Equipment UseWith the exception of UHF equipment, all items sold by Spy Equipment UK are legal to operate within the UK and Europe. All responsibility, however, for any infringement of another person’s Human or Privacy rights is squarely upon the customer. As such it is the customer's responsibility to ensure that the equipment is used in compliance with all Human Rights, Privacy Rights, Civil and Criminal laws active in the area of use. By accepting these terms and conditions you agree to take full responsibility for the use of any equipment purchased from Spy Equipment UK. Although it is not an offence to manufacture or possess a UHF transmitter in the UK, the UHF transmitters featured on this site are not D.T.I. approved and the use of them would be an offence. These devices are sold for export only. MiscellaneousDue to the nature of the equipment any goods sold by Spy Equipment UK are not sold on a trial or return basis with the exception of GPS Vehicle Trackers, see the GPS Vehicle Tracker Hire section of these Terms and Conditions. Although we will give as much advice as possible we cannot be held responsible for the suitability of a products use in a particular situation either known or unknown. We understand however that a customer may purchase a product in error that is unsuitable for a particular use and we will, at our discretion, allow a part-exchange to be made for a more suitable product from our range. Specifications are subject to change as we are continually improving our product range. Spy Equipment UK reserves the right to substitute products that are out of stock or discontinued with products of a similar nature. If, by mistake, we have under priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we dispatch the item to you. In those circumstances, we will notify the correct price to you so you can decide whether or not you wish to order the item at that price. If you decide not to order the item, we will give you a full refund on any amount already paid for that item in accordance with our refund policy. Quotations are valid for the period stated and represent no obligation until the seller accepts the buyers order and are subject to the goods being available at the time requested. The telephone equipment featured in this catalogue is not approved by British Telecom. Due to the limitations of GPS technology Spy Equipment UK cannot guarantee 100% accurate positioning every time when using any of our GPS tracking devices. This can also include false reports that can be given by the unit due to satellite movement. Please refer to the Help Desk for limitations on GPS technology. The ranges quoted for our transmitters are approximate and were achieved on flat terrain in direct line of sight of the transmitter. Unlike many companies we have not exaggerated the quoted range or increased it by climbing a mountain to achieve unrealistic transmission distances. For this reason we do not guarantee a certain transmitter will always transmit the same distance as quoted as many factors can affect the transmission range such as structures, climatic and geographical conditions, battery condition, location of transmitter and the type of receiver used. If any of the above terms and conditions are found at Law to be invalid, the remaining terms and conditions will remain applicable in full.
